WASHINGTON, Dec. 15, 2010 -- The American Legion remains strongly opposed to a renewed and intensified Congressional effort to hastily repeal the Pentagon’s “Don’t Ask, Don’t Tell” law during Congress’s rapidly expiring lame duck session. The House is expecting to begin debate today on a stand-alone repeal of the military's ban on gay servicemembers revealing their orientation. Majority Leader Steny Hoyer (MD) and Rep. Patrick Murphy (PA) have been working on the issue, and their language tracks with a bipartisan bill introduced in the Senate last week. The Senate may consider a similar bill later this week. The leader of the nation’s largest veterans’ service organization expressed alarm over this latest effort to swiftly overturn the controversial law. “One must ask, what’s the rush?” said Jimmie L. Foster, national commander of The American Legion, “and why should this matter of social policy take precedence over the far more critical matter of national security?” Foster was referring to repeated failure within Congress to pass the overarching National Defense Authorization Act which authorizes appropriations for military activities of the Department of Defense, military construction, equipment acquisition, and military personnel strengths for the 2011 fiscal year. The bill has been set aside in the Senate due to a number of controversial provisions including Don’t Ask Don’t Tell repeal language. “While our combat troops continue to focus on their mission on the war-front throughout the world, Congress can’t focus on funding those very service members,” said Tim Tetz, director of the Legion’s legislative division. “Congress should rush to pass the Defense Authorization Act and take whatever time is necessary to understand the nuances a repeal of Don’t Ask Don’t Tell would have on our nation’s fighting forces.” The American Legion has repeatedly asserted that now – in the midst of war – is simply not the time for social experimentation. This cautionary message was the same offered by Commandant of the Marine Corps Gen. James Amos and the leadership of the Army and Air Force. They all agreed in testimony last week before the Senate Armed Services Committee that repeal of Don’t Ask Don’t Tell would be a distraction upon those in combat roles today. Robert W. Spanogle, a past national commander of The American Legion, is critical of the rush to repeal DADT . “Count me in with the Commandant and those soldiers and Marines in the mud on the front lines in Afghanistan and Iraq, the tip of the spear,” said Spanogle. “Nearly 60 percent of those surveyed said they believed there would be a negative impact on their unit’s effectiveness (with a repeal of Don’t Ask Don’t Tell).” While the House and Senate remain committed to passage of a repeal of Don’t Ask, Don’t Tell, critics join The American Legion in questioning the need to rush this issue to a vote. More than 13 hearings were held when the original law was enacted and the House hasn’t held hearings on the findings of the Department of Defense survey of service members. “The American Legion remains convinced a repeal of ‘Don’t Ask, Don’t Tell’ cannot be easily implemented and could compromise the effectiveness of crucially needed fighting forces. Political expediency should not take precedence over providing adequate time for debate. There is no reason this must be decided in the next two weeks when it has been in place for seventeen years,” concluded Foster.

Thank you Commander Foster you have been correct on your every statement on this issue. I was a B-29 gunner during the Korean Conflict. and I joined the Legion when they went after the Smithsonian PC in the B-29 Enola Gay display. The Legion has taken the right stance ever since. From Enola Gay to this Gay issue, your response is right on.

I support the Legion, but I don't agree with it's position on DADT. If people can make it through the training they should be able to serve. If they have personal issues that conflict with their performance in their unit they should be dealt with by their CO under the UCMJ like everybody else. Todays troops are much more sophisticated than we were back in the day.

During sex ed, we were told that if they know you're streight, they'll leave you alone. They lied! Big time!! My sister had some friends, most were carefree easy going people, and one was a freak. They all knew I was having problems at home, my step father love that child support my dad sent, he just didn't like having a child in the house. They were supportive and understood where I was coming from. The freak just kept pushing his homosexual lifestyle on me. I also found out later from my sister, that he had raped one of my friend who attempted suicide the next morning. The freak slipped him a micky. I was molested by some freak while trying to help my step father at work. A young man in my unit was gang raped in DC, but they were protected by the Barney Frank Protection Plan! Probably male protitutes that worked out of his apartment. And all the way up to my mid twenties they would bother me. So you can take your homophobic crap and shove it where the sun never shines.

The fact is that if you want out you pull a Klinger and say you are gay. Repeal of DADT is a stop-loss measure...nothing less, nothing more. I am, however, saddened by the open faggotry of the Legion leadership. It's a shame that the Good Ole Boys aren't dead yet.

I am furious. The Legion does not speak for me or for any true American. I did not serve to enforce ignorance and bigotry. DADT is a stain on America and for the Legion to oppose its elimination is unconscionable. Who approved this position? They should resign immediately. America stands for freedom and equal rights for EVERYONE.

I don't agree with this organization's discrimination against patriotic Americans who have and do service their country through military service. I resign from your organization. You appear not to be well informed about the issues and the attitudes of today's military. This is not 1940. There are African Americans, women and non-Christians in today's military....even gays. And it is the best military in the world.

For the love of Pete... there's nothing "last minute" about this. As long ago as 1993, the Rand Corporation - the respected think-tank that we've relied on ages - issued a report concluding that the best course of action was open-serve. We've let a rear guard of reactionaries stave off action on that conclusion for far, far too long.

It's *past* time to repeal DADT.

'social experimentation'? I thought this organization represented the interests of veterans. I served in the Air Force for six years, and completed one downrange deployment in a warzone. I worked with, lived with, and befriended gay and lesbian service members for the entire duration, without a single problem. My father and brother are also veterans, and have worked with gays and lesbians in the Navy and Airforce. Their 'gayness' never presented itself as a hindrance to the mission, and it was never expected to. The Legion enables the abject discrimination of thousands of veterans by referring to the proper and necessary repeal of the deplorable, ignorant, and backwards DADT policy as 'social experimentation'. That gives these very real veterans and service members less than the respect they deserve. This organization forgets that wearing and serving in uniform in any branch of the military sets aside ALL barriers connected to gender, race, ethnicity, and yes, sexuality. DADT is discrimination, it absolutely segregates. DADT is the 'social experiment'...and it reflects badly on all branches.

Oddly, the American Legion supports a policy that over 92% of service members who have worked with gays and lesbians have declared essentially pointless? This is not the Legion I thought I knew.

Surprised to hear other Vietnam vets say they served with all those gay soldiers - claiming to be gay was a common way to beat the draft! I was a draftee and never heard anyone claim to be gay serving in Nam. I'm not saying there were no gays in the service, but they must have kept it private.

When I was in during the 80's, our squadron averaged about 10% gays. That of course doesn't count the truely closeted, which would have made the percentage higher. Just like regular sexual unions, if one party is not attracted to the other, the matter is closed. Pressing it further is harrasment. To adopt a Nancy Regan phrase, "Simply say No, Thanks." The Legion can have any opinion they wany individually, but as a group, we shouldn't support discrimination and hatered. It's unAmerican.

Col. MacLaren is indeed a wise man... After reading these posts, I must say, I am really disgusted with those who would stop good americans from serving their country just because they are gay... Gays have been serving since military time began... I think those who are against the repeal are blinded by their bigoty. The same arguments were used when the services integrated blacks... And how about the Japanese when they were incluced in the service in WWII.... Same arguments. I am a member of the American Legion and retired from the Navy after 22 years... I have belonged to the American since I retired in 1995... When did we, as members, get to vote on DADT.... AND since when has the military voted on social issues... The American Legion has gay retired military personnel as members... With this stand by the American Legion, I find myself no longer proud to be a member of what I find to now be a biggoted association... I will not renew my membership...

Are you serious? Those percentage numbers are hilarious!! There are more active servicemembers that say that repealing DADT will not hurt morale!! I think that they should have stated that the "Legion commanders and other members with their heads so far up their butts that they can see their souless insides, disagree with repealing DADT"! I will renew my membership if only to speak with a louder voice. Thank you to EVERY veteran for your service.

The title of your press release is incorrect. The "American Legion" does not oppose DADT repeal as the matter has not been put to the membership for a vote. You should state that - "The current leadership of the American Legion opposes...". If the comments from other veterans mean anything at all, this disconnect between the "leadership" and the members will be rectified in the near future. If not, it appears that the membership of this organization faces a rather rapid decline. Those of us who thought the American Legion stood up and supported ALL of our active and former servicepeople are stunned and sickened by this blatantly homophobic stance and will not tolerate it for very long. I, for one, after decades as a member, will not be renewing my membership after 2011 if the "leadership" of this organization can't learn that this is the 21st century and their 19th century way of looking at things needs major rethinking.

Don't believe the phony liberal media reports that 70% of troops support open homosexual service, because that statistic included 'mixed' feelings. A closer reading of the fine print in the newly released Pentagon survey shows our troops answered as follows:

Q45. If you had a leader whom you believed was gay or lesbian, 9% positive, 91% negative or mixed effect on unit's performance.

Q68c. 85% of Marine Combat Arms, 75% of Army Combat Arms, 64% overall say Negative, Very Negative, or Mixed impact on unit trust.

Q90. 29% would take no action if assigned open showers. 71% would shower at other times, complain to leadership or chaplains, don't know or do "something else" [including violence.]

Q81. 24% will leave the military or think about leaving sooner than planned. [One half million troops will QUIT early, destroying national security.]

Q80. 6% will positively recommend service to others after repeal. 94% feel negative, mixed, no effect, or don't know about recommending military service to others. [Destroying recruiting efforts.]

Q66. If open homosexuality impacts combat performance, is the impact....9% positive, 91% negative or mixed impact.

Q71. 11% feel positive or very positive about open homosexuality in field environment or out at sea. 70% negative or mixed. 19% no effect.

Q73. 5% say repeal would positively boost morale. 41% say negative or mixed impact morale. Rest no effect or don't know.

In summary, the real stats prove our nation faces a NATIONAL SECURITY DISASTER if Don't Ask, Don't Tell is repealed, and open homosexual aggression is forced upon our troops against their will.

I cannot believe the legion. The pledge of allegiance, which is said at every American Legion gathering specifically states "equality for all". This doesnt seem like equality for all. This seems like a bunch of old farts that are still embedded in their small little minds. When this does get passed, the legion will be remembered for strongly opposing DADT and thats a shame for a service orginization that does so much. This will put a redmark on the hardcard for eternity. Whats the rush to repeal DADT? Thats a f@#$in joke. This has been in the works for years. People are so ignorant. People are so contradictory when theres something they are either afraid of or dont understand. This went on in the past with almost every subset of persons, especially women and blacks. They were denied equal rights for the longest time and this is exactly what is happening with DADT. Some of the people that I have met or been friends with people that are gay, females and males, are even more intelligent then a majority in the military. Its the hicks, ignorant and/or old people that are opposed to DADT. I hate to see an orginization that I love so much do something so wrong. Why do we as Americans basically ignore our constitution, unless it can work to our advantage. Most pols cant even leaveor dont even know that church and state should be completelyseparate, and that is what America was based upon, people trying to escape England because of religious persecution. If we as people are not going to follow what we say then we should abstain from saying it. POINT BLANK.

For all those who are considering leaving the Legion over this issue, give an extra day's thought to that before you leave. Remember that 20 months ago, people like you were joining the Legion because of our public stand against both the Administration's proposal to require private health insurance to pay for service-connected treatment and the DHS report on right-wing extremism. Many of the same people that are being slammed in many of the comments here were heavily involved in the decisions on those issues.

The positions of the Legion are determined by those who are invested enough to be out doing the work of the organization. I know of no state that filled their entire delegation at the National Convention last year. Find out how to be part of your state's delegation. Go to Minneapolis this year and make your voice heard. No one wins every fight but those who disagree and leave won't be part of the next decision. Don't fool yourself, there will be a next decision.

One last thing before you leave. Go to the Legion's website at www.legion.org. Take a look at the list of resolutions there, positions that address a wide range of veterans' issues. If your disagreement with the Legion on DADT overrides all those other things and all the work that is being done, so be it. But frankly then I think your commitment is veterans' issues and concerns may not be as deep as it should be.

As a six-year veteran who served along side fellow servicepeople whom I have know to be gay (1966-1972) I hardly think this is a "rush job" . In fact, such an accusation smacks of the same attitude used by Southern politicians in denying Blacks rights guaranteed by the Constitution yet not enforced until the Civil Rights Act of 1964. There never seems to be a "right time" to guarantee full citizenship to any disenfranchised segment of our population. black served proudly in every war up to that time and always with the promise of full citizenship, yet, when the time came to fulfill the promise, nothing was done until mandates and time frames were put into place and teeth weree put into enforcement. The "tyrany of the majority" is no reason to deny equal rights to those who serve proudly.

Right on Legion. I spent 30 years in the US Navy and surely did not want someone of the same sex looking at me as a sex object. Say what you may, the military has been used as a fishing pond for them, especially lesbians, for years. I speak from experience on that.

Explain Why? DADT is more important than our Troops lives? I was raised in a Military Family.And am both an ARMY Brat and have done my service and then some. However, as I said WHY ARE WE WORRIED SO MUCH ABOUT THIS POLICY, WHEN WE SHOULD BE FOCUSING ON THE HEALTH AND WELL BEING OF OUR TROOPS AND HOW TO BRING THEM HOME SOONER!

I agree with the Legion's position on this issue. I wonder who is really driving this repeal and why they insist on such a demoralizing policy when we are at war. What is wrong with keeping one's private life private?

When did we get the opportunity to vote on this issue? I must join the 'strongly disagree' members of the Legion. I learned to ignore married shipmates' "sexual orientation"/infidelity and rampant alcohol abuse, as long as they did their jobs. I could care less about what fellow Americans do in the privacy of their bedrooms; and would be proud to stand beside anyone who wants to serve our country.

What is the difference between having gay people in the military,compared to having gay people in the senate and/or house who are making decisions reguarding our country.If there are those that want gays out of the military,then they should be put out of public office.

Chaplain, the wording of the questions in your post prove just how you can skew statistical results to say what you want. The way you lump results ranging from negative to mixed to no effect to don’t know on one side of the scale vs. positive on the other makes everything sound just scary.

If you are going to use statistics, bring on the complete results or link to the source. The way you quote them, they lack all credibility.

I server 20 yrs (1958 - 1978) in the USAF long before DADT. Homosexuality was NOT permited back then, yet I was approached by more than one person who was lying then and getting away with it. DADT is not teaching our young troops to lie it is permitting a life style that many including myself, do not believe is moral and God approve. I don't think we should have a DADT policy and we do not need homosexual service members. They are NOT gay they are homosexual and have perveted the language to cover up their true behaviour.
If this sounds like homophobia or "gay bashing" then I will admit to it, but I also have the God given right to state my belief without fearing that others will look down on me. That is what the military service is all about, protecting those God given rights.

My philosophy is," If you leave me alone , I won't break your arm!" But, a story I heard when I was in Wilmington, NC., is sick! A woman was picked up hitchhiking by a trucker, he started making sexual advances on her. She told him she was a lesbian. He took her out of his truck and ripped out her uterus, and left her there.

I served with gays and lesbians when I was in the service in the 1960's. They were as good as anyone that ever wore the uniform. If we isolate them as a body, who or what body of society will be next!? I am disappointed with the Legion in it's coming out against this very old, very tired issue. We have enough areas to focus our emotional energy. I say repeal the NADT, and do it quickly. It should have been done when we realized our brothers and sisters of a different sexual orientation were serving honorably throughout our military history. It's not being rushed. It is time we face the real world of people and their needs and stop with the outside, irrelevant fears.

I've read the article and all the comments and noticed one fact missing: It dosen't really mattter what we support or oppose, this congress is going to do what they please and they don't seem to care what the American people want! The days of congress listening to the desires of groups like us ended some time ago. Now they just do as they please - voting for whatever will get them more power, or more money. Just look at the representitives who have gone to Washington and are now rich (when they weren't rich before). I know this does not apply to all of them, but the real honest ones get shutout from the decisions. I hope the new congress can turn this around, or our beloved country is in for very bad times. Many America's see this issue from a biblical perspective. The verse below is GOD's written judgement on homosexual acts. I did not write this but believe it. Homosexuality is a sinful act, one of many listed in the Bible and is committed as a choice. Like any sin some are more tempted than other to engage in the forbidden behavior but it is still clearly a choice. I can not legitimize what God condemns and contrary to popular "God does not change" and neither has His judgement on homosexual acts. Reject the act not the person just as with a thief, adulterer, or any other repetitive sinful act. God help our country in this hour of crisis!

I am so proud that the Senate followed the House and killed "Don't Ask Don't Tell". I am sorry that the "Dream Act" did not pass. As far as I am concerned, any person that wears the Uniform of the United States Military and gets an honorable discharge has earned the right to become a citizen. How many natural born citizens refuse to serve.

And I dare say, 99.9% of gays will not come out of the closet.
They'll continue to serve our great country and die for our great country as they have since 1775, and before, and no one will know.
The great part is they'll not be booted out of the service, if someone tells on them.

The leadership of the AL went out on a limb to take a political position that was NOT approved by a large and vocal segment (if not the majority) of its membership. It's recommendation was ignored by both houses of Congress. It is now time for those involved in taking that unsanctioned, gratuitous and unsuccessful position to step aside and turn over leadership to those more in synch with the membership and with American values.

This was a no-confidence vote of the AL leadership from above and below. You gambled AL prestige, you lost, and you should resign.

Guys have served in the armed forces since Alexander the Great (around 300 B.C.) and before. Old likely Gay Alexander was a pretty good soldier, and there have been many before and after him. I have great respect for the Commandant of the Marine Corps, but I think he is behind the curve on this issue. I don’t think those Marines on Iwo were too worried about the gay guy in his fox hole. Please, let’s move into the 21st Century.

The Legion should not even be in this argument. The Legion should be focused on doing what it can for all who have served, regardless of who they might be.
To pick and choose which veterans and servicemembers the Legion will acknowledge and support is a disgrace.

So is threatening members of Congress using the Legion as a club.

It's time for younger, more forward thinking members to take over the Legion, starting at local level and ending at National.
It might take a few years, but in time we might be able to refocus the Legion back its mission: to honor and support those who have sworn to defend the Constitution of the United States.

The Legion should be ashamed of its stance and support ALL people who want to serve our country. Who cares if people are gay as long as they pay their taxes and are good citizens?! I am a Legion member and nobody asked my opion before racing to support DADT - maybe in the future an electronic poll could be placed on the website, with emails going out to members, asking their opinons?

The Constitution gives them the right to believe as they choose in this matter, but it does not give them the right to call people who disagree with them bigots, period. I think rather that it is truth that bores them, as it bores so many people who live lives of fiction.

I must make apologies for misquoting Ms. Norman. She did write “old koots” and I mistook that for kooks. She’ll come back when the “old goats die off!” – if she has much longer to live! This is a truly an intolerant statement as well as a personal opinion.

Ms. Norman, do you know that in a store an opinion cannot even buy you a loaf of bread? You don’t have an opinion as much as hatred for another point of view. Please reconcile that with the Constitution and the Bill of Rights of the United States, then come back and talk like an adult.

It sounds like the American Legion is breaking the National Constitution. Also the Preamble is a good thing to read.

As a Vietnam combat veteran I witnessed firsthand the bravery and commitment of gay servicemembers as they fought and died alongside everyone else to defend freedom. Regardless of the outcome this weekend of the Senate vote on DADT, I cannot support the AL position on this because it is just wrong.

Too bad, the American Legion is still being run by old koots (bigots)!! Anyone who ever served in the military (U.S. Navy for me) KNEW plenty of gay people serving with them. Never was a big deal and won't be now! Thank God this nonsense is behind us!! Thank you Congress and thank you President Obama for ending this rediculous policy! I've cancelled my membership to the American Legion! I'll come back once the old goats die off!

The Legion's position is well reasoned and does not indicate any intolerance or discrimination as a reason unto itself for its position. As to the question of who and who cannot serve in the armed forces - there are many prohibitions to military service such as age, gender (for certain jobs), physical requirements, and educational requirements. One's medical (includes psychological) and legal history is also scrutinized, as well as one’s affiliations and associations. Any organization rightly discriminates and rightly is intolerant of particular actions and/or behaviors. The leaders of the Armed forces are still in debate with each other. There should be a consensus before the politicians jump the gun to please their political bosses. There is no need to rush this decision, especially since there is more pressing business that the government should be attending to. Legion Post 001

Reject hate. Embrace love. Support the nation. Repeal DADT.

"What's the rush?" is absolute nonsense. Political leaders said, "We'll change when military leaders ask." They asked. Political leaders said, "We'll change when the study is done." It's done. What they mean to say is "We will hold steadfast to our Christian prejudice no matter what." Lots of Christians reject hatred of homosexuals, finding Love in their Bible rather than hate.

A time of war is the perfect time to increase recruitment, to increase morale, to promote integrity over secrecy, to promote service over prejudice, and to reject centuries of discrimination and oppression.

Now IS the time.

I agree. When you're trying to kill the enemy and he's trying to kill you you don't need any distractions; but you DO need a buddy you can DEPEND UPON!
